This website is operated by Foodly Shop. Throughout the site, the terms “we”, “us” and “our” refer to offers on this website, including all information, tools, and services available from this site to you. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms & Conditions and consent regarding the conditions of use and sale.
1. ORDERS
1.1 Orders can be placed through our website (RECOMMENDED) or by writing an email to info@foodlyshop.com indicating the desired items and the quantity.
1.2 For all email orders, payment must be made by bank transfer and the order will be processed upon receipt of the transfer.
1.3 By clicking on "Buy now", you are placing a binding order for the items in your shopping cart. Once you have submitted your order, we will immediately send you an e-mail acknowledgement of your order & Payment.
1.4 As soon as the order will be shipped (According to the order processing times 2 working days) the customer will receive a second email containing the tracking number.
1.5 In the event that an item you have ordered is unavailable, we will let you know as soon as we can and, where payment has already been made, make a refund to your payment method without undue delay.
2. PRICES
2.1 All prices on the site are VAT included and may be subject to change. the prices given on the website on the date the order is placed shall apply.
3. PAYMENTS
3.1 We accept the following payment methods: debit and credit card, and payment through Paypal. We reserve the right not to accept certain payment methods for a given order and to refer to other payment methods. Please note You are responsible for any costs associated with money transactions.
4. DELIVERY & RETURNS METHOD
4.1 The deliveries are shipped using specialized couriers. At the time of delivery, the customer must ensure that the packaging has not been damaged.
4.2 If any Goods you have purchased do not comply or have been damaged when received please contact the courier withing 5 days of package receipt (Courier details available on delivery note and package tracking email)
4.3 Without prejudice to your statutory right to cancel, The consumer can, within 14 days of receiving the goods, exercise the right of withdrawal.
4.4 The consumer must return the goods at his own expense, which cannot be reimbursed.
4.5 The consumer must return the goods to the address that will be communicated by Foodly Shop to the customer. All returned items must be returned in their original condition, intact and undamaged, and in its original packaging
4.6 FOODLY SHOP does not reimburse shipping costs, either outward or return.
4.7 Any refunds will be automatically paid to the account you used for payment
5. DELIVERY COSTS
5.1 Delivery costs are charged to the customer, in some cases they may be free. These costs are expressly indicated at the time of checkout and can be consulted under the shipping costs item on the site.
6. LEGAL GUARANTEE
6.1 The products on the site comply with national and international legislation laws and are covered by the legal guarantee of conformity. This guarantee is reserved exclusively for consumers.
6.2 The warranties relating to the products are those provided by the manufacturers. The consumer has the right to avail himself of the legal guarantee provided for in the civil code. In the event of non-compliance of the products purchased by the consumer on our site, the customer can request the replacement of the products purchased.
6.3 The guarantee is valid for a maximum of 24 months from the date of delivery of the products. The consumer must communicate within 2 months from the finding of the non-conformity of the product to the customer service.
7. FINAL PROVISIONS
7.1 Product information is constantly updated. However, it is not possible to guarantee the complete absence of errors for which FOODLY SHOP cannot be held responsible for except in the case of gross negligence.
7.2 Buying any alcoholic product, the consumer declares to be of legal drinking age according to local legislation. FOODLY SHOP assumes no responsibility, in the event that the consumer has declared a different age.
8. PERSONAL DATA
8.1 To process an order through the website www.foodlyshop.com the consumer must create a customer account. All entered consumer's data will be stored in accordance with the provisions of the legislation on the protection of personal data. (Privacy Policy)
9. APPLICABLE LAW
9.1 The aforementioned terms and conditions are governed by and construed in accordance with the laws of Italy. For any disputes regarding these conditions, the Court of the consumer's locality will have exclusive jurisdiction as his residence or domicile, if located in the Italian territory, in all other cases the territorial jurisdiction is exclusively that of the Court of Caserta.
